Account Schedule for the Instant Funded Route under the Funded Trader Services Agreement

ZoneX AG, c/o STAX AG, Bahnhofstrasse 21, 6300 Zug, Switzerland

1. Scope and Order of Precedence

1.1 These Terms as Account Schedule

These Instant Funded Account Terms ("these Terms") form the standard part of the Account Schedule of every Instant Funded Account issued by ZoneX AG ("ZoneX"). Together with the Account Summary of the Account, they are the Account Schedule of that Account within the meaning of the Funded Trader Services Agreement (the "Agreement"). The Account Summary states the Account Configuration.

1.2 Documents That Apply

The Agreement governs the relationship between ZoneX and the Trader, including the nature of the Trader Services, the Trader's status as an independent contractor, the Trading Environment and the ownership of capital, the Service Fee, identity verification and sanctions screening, suspension and termination, liability, and governing law and jurisdiction. The Funded Trader Rules apply to the Account as the Trading Rules, subject to Section 1.4. The Terms of Use, the Privacy Policy, the Refund Policy and the AML & Sanctions Policy apply to the matters they govern, to the extent they are not inconsistent with the Agreement (Agreement §§17.5 and 20.8).

1.3 Order of Precedence

Under the Agreement §17.5, the order of precedence is:

(a) the Agreement, except that the Account Schedule controls with respect to expressly stated account-specific commercial terms;

(b) the Account Schedule, in which the Account Summary prevails over these Terms; and

(c) the Funded Trader Rules, including the provisions they incorporate by reference.

1.4 Account-Specific Terms

The following are expressly stated account-specific terms of an Instant Funded Account. They apply in place of the provisions of the Funded Trader Rules named below, as the Agreement §17.5 and the definition of "Trading Rules" in the Agreement provide:

(a) Section 6 states the risk rules of the Account in full. It applies in place of the provisions that Funded Trader Rules §2.2 incorporates from Challenge Rules Section 5 and Challenge Terms Sections 10.3, 10.4 and 10a. In particular, the Maximum Drawdown follows the High-Water Mark under Section 6.6 instead of a static floor. Challenge Rules Section 7 and Funded Trader Rules §2.3 (prohibited practices) continue to apply.

(b) Section 7.1 states the termination thresholds of the Account for the purposes of the Agreement §11.6. They include every termination threshold listed in Funded Trader Rules §2.2.

(c) Sections 9 to 12 state the remuneration conditions, the calculation and the payment cycle of the Account. They apply in place of Funded Trader Rules §§4.1 (First Request), 4.2 (Request Interval), 4.3 (Calculation), 4.4 (Rolling Cap) and 4.8 (Reference Level After a Payout). Funded Trader Rules §§4.5 (Processing), 4.6 (Pre-Payment Review), 4.7 (Payout Assets and Destination) and 4.9 (Identity Verification) apply.

(d) Section 3.2 states how these Terms, the Agreement and the Funded Trader Rules are accepted for an Instant Funded Account.

Every other provision of the Funded Trader Rules applies to the Account, including §5 (Account Scaling, as provided in Section 5.6), §6 (Inactivity), §7 (Suspension, Termination and Unpaid Remuneration) and §8 (Rule Changes).

1.5 Interpretation

Capitalised terms not defined in these Terms have the meaning given in the Agreement or the Funded Trader Rules. Percentages stated in the Account Configuration refer to the Starting Reference Level unless expressly stated otherwise. Headings are for convenience only. The illustrations in Annex 2 are for illustration only.

2. Definitions

In these Terms:

3. Instant Funded Route, Acceptance and Activation

3.1 Admission Without a Challenge

Under the Instant Funded Route, the Trader enters the Funded Trader Programme without first completing a Challenge (Agreement §3.3). An Instant Funded Account is not a Challenge. It has no evaluation phase, profit target or minimum number of trading days, and its issue is neither an award nor a prize.

3.2 Acceptance at Checkout

Before paying the Service Fee, the Trader accepts electronically, in one acceptance action at checkout:

(a) these Terms;

(b) the Agreement; and

(c) the Funded Trader Rules, each in the version in force and stated at checkout, together with the Account Summary. That acceptance is the Acceptance Event for the Account (Agreement §1.5). It is also the Trader's acceptance of the Funded Trader Rules for the Account, notwithstanding the statement in Funded Trader Rules §1 on acceptance at checkout. ZoneX records the versions accepted, the Account Summary, the time of acceptance and the other evidence described in the Agreement §1.5. An Instant Funded Account cannot be purchased while no version of these Terms, the Agreement or the Funded Trader Rules is in force.

3.3 Activation

ZoneX issues and activates the Account after the Service Fee has been received. The Account starts with the Starting Reference Level as Simulated Capital. The Trader may provide Trader Services through the Account from its activation (Agreement §3.4). Full identity verification is not a condition of purchase or activation, unless ZoneX requires earlier verification or screening under the Agreement §8.4.

4. Nature of the Services

4.1 Trader Services

Through the Account, the Trader provides Trader Services to ZoneX: trading decisions, strategy execution, signal generation, the testing and demonstration of trading strategies, the generation of Performance Data and the application of trading skill and risk-management techniques (Agreement §2.1). ZoneX receives, records and evaluates the Trader Services and the Performance Data for the commercial purposes described in the Agreement §2.2, including identifying traders and strategies that may be suitable for its proprietary trading activities, and may use Trader Output as provided in the Agreement §9.

4.2 Simulated Trading Environment

The Account is operated in a Simulated Trading Environment. Orders placed on it are executed in simulation against the market data of the venue the Trader trades and are not transmitted to any exchange or counterparty. The Starting Reference Level, the Realised Balance and every other displayed balance, position and result are Simulated Capital and simulated performance records. They are not money or assets of the Trader, are not deposits, are not repayable and cannot be withdrawn, transferred or pledged (Agreement §§4.2 and 4.5). ZoneX does not hold, manage, invest or trade assets for the Trader (Agreement §4.4).

4.3 Performance Remuneration

Performance Remuneration is contractual compensation payable by ZoneX from its own assets for Qualifying Performance and Trader Services rendered under the Agreement, calculated under Section 10. It is not a prize or winnings, a withdrawal of Simulated Capital or simulated profit, a repayment of or return on the Service Fee, an investment return, or a share of any ZoneX account, asset or position (Agreement §§6.1, 6.5 and 7.4). No Performance Remuneration arises merely because the Trader purchased the Account, accepted the Agreement or shows a positive balance (Agreement §§1.4 and 6.3).

4.4 No Advice and No Guaranteed Amount

ZoneX does not provide investment advice. Simulated results are not indicative of results in live trading. ZoneX does not guarantee that the Trader will generate Qualifying Performance or receive any Performance Remuneration (Agreement §§6.7, 13.2 and 13.3).

5. Service Fee and Account Configuration

5.1 Account Configuration

The Trader selects the Account Configuration from the options ZoneX offers at checkout; Annex 1 lists the options at the date of these Terms. The Account Summary states the Starting Reference Level, the Remuneration Percentage, the daily loss percentage, the maximum drawdown percentage, the maximum leverage, the settlement currency and the remuneration conditions: the waiting period, the minimum Window Profit, the maximum Consistency Ratio, the Buffer, the maximum Calculation Amount per request and the minimum Performance Remuneration per request. The Account Configuration applies to the Account for its entire term.

5.2 Service Fee

The Service Fee is a fixed fee, paid in advance, for one Account. It is consideration for ZoneX's platform functionality, software and technology, access to the Account Configuration and the related services, and is received by ZoneX for its own account as revenue (Agreement §§3.3 and 7.2). It is not a deposit, an investment, trading capital, margin, collateral or client money. It is not credited to the Account, is not used to fund Performance Remuneration and does not determine its amount (Agreement §§7.3 and 7.4). Where ZoneX accepts the Service Fee in cryptocurrency, the cryptocurrency is received by ZoneX for its own account as payment for its own services (Agreement §7.5).

5.3 No Refund by Reason of Performance

The Service Fee is not refunded because the Account is deactivated for reaching a termination threshold, because the Trader generates no Qualifying Performance or stops trading, or because the Trader terminates the Agreement, except where a refund is required by mandatory law or provided in the Refund Policy (Agreement §§7.3 and 11.3).

5.4 Availability and Limits

ZoneX may offer, suspend or discontinue the sale of Instant Funded Accounts and may limit the number of Instant Funded Accounts outstanding at any time. The aggregate notional size of all simulated accounts a Trader holds at one time, Challenge accounts included, may not exceed USD 1,000,000; a purchase that would exceed it is refused before payment. A completed and paid purchase is fulfilled. Promotions granting more than one account for a single fee do not apply to Instant Funded Accounts.

5.5 One Account per Purchase

A deactivated Account is not reset or replaced. A new Account requires a new purchase at the Service Fee then applicable.

5.6 Account Scaling

Funded Trader Rules §5 (Account Scaling) applies to the Account. An increase takes effect through an amended Account Summary accepted by the Trader, which states the new Starting Reference Level and the Realised Balance, Daily Reference Balance and High-Water Mark adjusted to it. From its effective time, these Terms apply to the new Starting Reference Level.

6. Risk Rules

Sections 6.1 to 6.8 are the account-specific risk requirements of the Account (Section 1.4(a)). An action that reaches a termination threshold is carried out; reaching the threshold does not refuse the action but deactivates the Account under Section 7.2.

6.1 Leverage

The leverage setting of the Account for an instrument may not exceed the maximum leverage stated in the Account Configuration; a setting above it is refused and is not a breach. The leverage setting determines the margin of a position and, with it, the position's liquidation price. An Account with a maximum leverage of 1:1 trades spot instruments.

6.2 Stop-Loss

Every open position must be protected over its full size by a stop-loss. An order that opens or increases a position reaches a termination threshold unless the stop-losses placed with it cover its full quantity. Cancelling, reducing or removing a stop-loss so that an open position is no longer fully covered reaches a termination threshold. An order that only reduces or closes a position requires no stop-loss.

6.3 Stop-Loss Distance and Liquidation

For a leveraged position, the stop-loss must lie no further from the entry price than 90% of the liquidation distance: the distance between the entry price and the price at which the position would be liquidated, derived from the margin rates the venue publishes for the instrument, the leverage setting and the position size. Opening a position, placing or moving a stop-loss, raising the leverage setting or removing margin, so that a stop-loss lies beyond that distance, reaches a termination threshold. A position with a leverage setting of 1:1 and a spot holding are not subject to this distance. The liquidation of a position reaches a termination threshold.

6.4 Daily Loss Limit

The Daily Loss Limit is breached if, during a Trading Day:

(a) the net loss realised on that Trading Day reaches the Daily Loss Limit; or

(b) that net loss, together with the Open Risk of all open positions, exceeds the Daily Loss Limit.

The net loss realised on a Trading Day is the negative of its Day Result so far, and nil where the Day Result is a profit. Profits realised during a Trading Day therefore offset losses realised on the same Trading Day. They do not increase the Daily Loss Limit and do not offset Open Risk.

6.5 Maximum Drawdown

The Maximum Drawdown is breached if:

(a) the Realised Balance reaches or falls below the Drawdown Floor; or

(b) the Realised Balance less the Open Risk of all open positions falls below the Drawdown Floor.

6.6 High-Water Mark and Drawdown Floor

The High-Water Mark is determined once per Trading Day, at 02:00 Europe/Zurich time, on the Realised Balance. It is not determined intraday and does not take open positions into account. The Drawdown Floor is the High-Water Mark less the Maximum Drawdown Amount, but never higher than the Starting Reference Level: once the High-Water Mark reaches the Starting Reference Level plus the Maximum Drawdown Amount, the Drawdown Floor stays at the Starting Reference Level. A reservation under Section 10.3 does not reduce the High-Water Mark.

6.7 When the Rules Are Assessed

Sections 6.2 to 6.5 are assessed when an order is placed and when it is executed, when a stop-loss is placed, moved, reduced or removed, when the leverage setting is changed and when margin is removed from a position. When an order that opens or increases a position is placed, the Open Risk it would add is included: the loss to its stop-loss, including the trading fee for closing, and the full entry value of any quantity no stop-loss covers. An order that only reduces or closes a position is not assessed against Sections 6.4 and 6.5. Once placed, an order that has not been executed adds no Open Risk. The rules are calculated on the Realised Balance and on stop-loss levels; the market price and the unrealised result of open positions are not taken into account.

6.8 Settlement Currency

The Account is denominated in the settlement currency stated in the Account Summary. Placing an order in an instrument that settles in a different currency reaches a termination threshold.

7. Termination Thresholds and Deactivation

7.1 Termination Thresholds

For the purposes of the Agreement §11.6, each of the following is a termination threshold of the Account:

(a) breaching the Daily Loss Limit (Section 6.4);

(b) breaching the Maximum Drawdown (Section 6.5);

(c) a liquidation event (Section 6.3);

(d) a stop-loss beyond 90% of the liquidation distance (Section 6.3);

(e) an open or increased position not fully covered by a stop-loss (Section 6.2); and

(f) an order in an instrument settled in another currency (Section 6.8).

7.2 Deactivation

When a termination threshold is reached, ZoneX deactivates the Account with immediate effect: it closes all open positions and cancels all open orders, and the Account can no longer be traded (Agreement §11.6). Deactivation does not affect a Reserved Request (Section 13.2).

7.3 Prohibited Trading and Other Breaches

Prohibited Trading and other breaches of the Agreement or the Funded Trader Rules are dealt with under the Agreement §§5.6 and 11.5.

7.4 Records

ZoneX's records of the Account's orders, executions, stop-losses and balances are evidence of whether a termination threshold was reached, save for manifest error. A decision may be challenged through the Complaints Procedure (Funded Trader Rules §7).

8. Suspension

8.1 Suspension

ZoneX may suspend the Account on the grounds stated in the Agreement §11.1. On suspension, ZoneX closes all open positions, cancels all open orders and informs the Trader of the reason (Agreement §11.2). A suspension is not by itself a determination that the Trader has breached the Agreement.

8.2 Effect of Suspension

While the Account is suspended:

(a) no position can be opened;

(b) no Remuneration Request can be submitted, and the approval of a Reserved Request is deferred (Section 12.2); and

(c) the Trading Days of the Account do not roll, so that the Daily Reference Balance and the High-Water Mark are not updated.

8.3 Lifting a Suspension

When a suspension is lifted, the Realised Balance, the Daily Reference Balance and the High-Water Mark are restored to their values immediately before the suspension, adjusted for any Calculation Amount restored under Section 12.4 during it, and the result of closing positions under Section 8.1 is disregarded. Positions closed on suspension are not reopened. Where the suspension ends with a determination under the Agreement §5.6 or §11.5, that determination applies.

9. Remuneration Requests

9.1 Conditions

The Trader may submit a Remuneration Request through the ZoneX platform only if, when it is submitted, all of the following conditions are met:

(a) the waiting period stated in the Account Configuration has elapsed since the Payout Window began;

(b) the Window Profit is at least the minimum Window Profit stated in the Account Configuration;

(c) the Consistency Ratio does not exceed the maximum stated in the Account Configuration;

(d) the Calculation Amount under Section 10.1 is greater than zero and the Performance Remuneration on it is at least the minimum stated in the Account Configuration;

(e) the Account has no open positions;

(f) no other Remuneration Request for the Account is pending;

(g) the Account is active and not suspended;

(h) the Trader has accepted the Agreement and the Funded Trader Rules, each in its version in force; and

(i) the Trader has completed identity verification under Section 11.1.

9.2 Completed Trading Days

Only completed Trading Days count towards the Window Profit and the Best Day.

9.3 Payout Window

The first Payout Window begins when the Account is issued. A new Payout Window begins at the time of each Reserved Request, so that the next request is judged only on results realised after it: on the Trading Day of the request, only the part of the Day Result realised after the request counts towards the new Payout Window, and its waiting period runs from the request. If a Reserved Request is rejected under Section 12.4, the new Payout Window lapses and the Payout Window that applied before the request continues as if the request had not been made, including every Trading Day completed since the request, counted in full.

9.4 Consistency Ratio

A Consistency Ratio above the maximum is not a breach and does not deactivate the Account. It only prevents a Remuneration Request until the Window Profit has grown enough for the Consistency Ratio to fall to the maximum.

9.5 Requests Cannot Be Withdrawn by the Trader

A Reserved Request cannot be withdrawn by the Trader.

10. Calculation and Reservation

10.1 Calculation Amount

The Calculation Amount is the lowest of:

(a) the maximum Calculation Amount per request stated in the Account Configuration;

(b) the Daily Reference Balance less the Starting Reference Level and the Buffer; and

(c) the current Realised Balance less the Starting Reference Level and the Buffer.

10.2 Performance Remuneration

The Performance Remuneration for a request is the Calculation Amount multiplied by the Remuneration Percentage. The Calculation Amount is a measure of Qualifying Performance used to calculate the Performance Remuneration. It is not an amount owed to or held for the Trader.

10.3 Reservation

When a Remuneration Request that meets the conditions of Section 9.1 is submitted, ZoneX reserves its Calculation Amount at once: the Realised Balance and the Daily Reference Balance are reduced by the Calculation Amount, the High-Water Mark is not reduced, and a new Payout Window begins (Section 9.3). If the conditions are no longer met at the moment of reservation, the request is not accepted and nothing is reserved. A reserved Calculation Amount is no longer exposed to trading on the Account: later losses, a breach, a suspension, or the deactivation or termination of the Account do not reduce it.

10.4 Effect of a Reservation

A reservation completes the calculation and confirmation of the Performance Remuneration under the Account Schedule for the purposes of the Agreement §6.3(d). The Performance Remuneration remains subject to:

(a) the verification, sanctions-screening and payout-verification conditions of the Agreement §8 and Section 11;

(b) the pre-payment review under Funded Trader Rules §4.6; and

(c) Section 12.4. A reservation is a step in the calculation of the programme metrics. It does not create a deposit, wallet, stored-value or trading balance for the Trader (Agreement §6.8), and a reserved Calculation Amount cannot be traded, transferred or otherwise used on the Account.

11. Identity Verification and Sanctions Screening

11.1 Identity Verification Before the First Request

Before the first Remuneration Request, the Trader must complete the identity verification required by ZoneX. It is carried out through a third-party provider and may include an identity document and a liveness check. ZoneX completes identity-based sanctions screening no later than before the first payment of Performance Remuneration and may repeat it before later payments or at any other time where reasonably necessary (Agreement §§8.1, 8.2 and 8.5).

11.2 Not Required for Purchase or Trading

The purchase, activation and trading of the Account do not require prior verification, unless ZoneX requires earlier verification or screening under the Agreement §8.4. The Trader bears the risk of not completing verification: until the verification, sanctions-screening and payout-verification requirements are satisfied, no Performance Remuneration becomes due and payable (Agreement §§6.4 and 8.2).

11.3 Sanctions

Sanctions obligations apply at every stage of the relationship, not only at payment. ZoneX makes no payment where it would violate applicable sanctions, anti-money-laundering or other mandatory law. Where information indicates a sanctions concern, ZoneX may suspend access, defer payment, request additional information, restrict activity or terminate the Agreement (Agreement §§8.5, 8.6 and 15.4; AML & Sanctions Policy).

11.4 Personal Data

Personal data processed for verification and screening are handled in accordance with the Privacy Policy (Agreement §12.6).

12. Review, Approval and Payment

12.1 Review

ZoneX reviews each Reserved Request under Funded Trader Rules §4.5 (Processing) and §4.6 (Pre-Payment Review). The conditions of Section 9.1 are assessed when the request is submitted and are not assessed again at approval.

12.2 Approval and Deferral

ZoneX approves a Reserved Request once:

(a) the Trader has satisfied the verification and sanctions-screening requirements of Section 11;

(b) the Trader has accepted the Agreement and the Funded Trader Rules, each in its version in force; and

(c) the Account is not suspended. Until then, the request remains pending and its approval is deferred; it is not rejected for that reason alone (Agreement §§8.6 and 11.2(d)). The deactivation or termination of the Account after the request does not prevent its approval.

12.3 Payment

ZoneX pays approved Performance Remuneration exclusively from its own assets, through a fiat or cryptocurrency payment method it supports, to a bank account held in the Trader's name or to a cryptocurrency wallet that ZoneX reasonably verifies is owned or controlled by the Trader (Agreement §§6.5 and 6.6; Funded Trader Rules §4.7). Where cryptocurrency is used, the payment settles ZoneX's own remuneration obligation and is not custody, exchange or transmission of assets belonging to the Trader. The Trader's choice among supported payout assets determines only the method by which ZoneX discharges its obligation. The Trader is responsible for the Trader's own taxes and duties on Performance Remuneration received, and ZoneX may make deductions, withholdings or reports where required by law (Agreement §§10.10 and 14.2).

12.4 Rejection

ZoneX may reject a Reserved Request, stating the reason, only where it determines in accordance with the Agreement that:

(a) the results on which it was calculated do not constitute Qualifying Performance, in particular because of Prohibited Trading, fraud, account sharing, manipulation or the exploitation of a technical error (Agreement §§5.6 and 11.7(c));

(b) payment would violate applicable sanctions, anti-money-laundering or other mandatory law (Agreement §§8.6 and 11.8); or

(c) the Trader has not completed the verification requirements within a reasonable period after being asked, or has provided materially false or misleading information (Agreement §8.6). On rejection, the reserved Calculation Amount is restored to the Realised Balance and the Daily Reference Balance, and the previous Payout Window continues under Section 9.3. ZoneX may withhold a Reserved Request pending a bona fide investigation without rejecting it (Agreement §11.7(b)).

12.5 Payments Obtained Improperly

The Agreement §6.9 applies to Performance Remuneration paid in respect of activity that did not constitute Qualifying Performance.

13. Termination and Earned Remuneration

13.1 Termination

The Account terminates upon:

(a) its deactivation under Section 7.2;

(b) its termination by ZoneX under the Agreement §11.4, §11.5 or §11.9, or for inactivity under Funded Trader Rules §6; or

(c) the termination of the Agreement by the Trader under the Agreement §11.3.

13.2 Reserved Requests Survive

The deactivation or termination of the Account, for whatever reason, does not cancel or reduce a Reserved Request. It remains subject to Sections 11 and 12 and is approved and paid accordingly (Agreement §§11.7(d) and 11.11).

13.3 Results Not Reserved

Termination does not entitle the Trader to the Realised Balance, Simulated Capital or any displayed simulated profit (Agreement §11.7). Results that have not been reserved on a Remuneration Request before the Account is deactivated under Section 7.2 do not give rise to Performance Remuneration (Agreement §11.6).

13.4 Settlement on Closing Without Fault

Where ZoneX terminates the Account without cause (Agreement §11.4), discontinues the programme (Agreement §11.9) or closes the Account for inactivity (Funded Trader Rules §6), ZoneX closes all open positions and, at the time of closing, reserves the Calculation Amount under Section 10.1 that a Remuneration Request made at that time would give. The waiting period, the minimum Window Profit, the maximum Consistency Ratio and the minimum Performance Remuneration do not apply to it, and nor do the other conditions of Section 9.1; the Buffer and the maximum Calculation Amount per request apply. The amount reserved is a Reserved Request for the purposes of Sections 12 and 13.2. A Reserved Request already pending at the time of closing is not affected, and the settlement is calculated on the Realised Balance after it.

13.5 Discontinuation of Sales

Suspending or discontinuing the sale of Instant Funded Accounts does not affect an Account already issued.

14. Agreement Versions and Amendments

14.1 Agreement and Funded Trader Rules in Force

No position can be opened or modified on the Account while no version of the Agreement is in force. If ZoneX publishes a new version of the Agreement or of the Funded Trader Rules, the Trader must accept it within the period stated at publication to continue opening or modifying positions; after that period and until acceptance, the Trader may only close positions and cancel orders (Agreement §§5.7 and 17.2). A Remuneration Request requires acceptance of the versions in force (Section 9.1(h)).

14.2 Amendments to These Terms

The version of these Terms accepted at checkout applies to the Account for its entire term, together with the Account Configuration (Agreement §5.7). A later version applies to purchases made after its publication. It applies to an existing Account only where the Trader expressly accepts it, where it is exclusively favourable to the Trader, or where an immediate change is required by law, regulation, sanctions, security, fraud prevention or material platform-integrity requirements (Agreement §§15.5 and 17.2). No amendment retrospectively reduces or cancels Performance Remuneration properly earned, including a Reserved Request (Agreement §17.4).

14.3 Funded Trader Rules

Changes to the Funded Trader Rules are governed by the Agreement §§5.7 and 17 and Funded Trader Rules §8; a new version is accepted as provided in Section 14.1.

15. Final Provisions

15.1 Governing Law, Liability and Disputes

Liability, force majeure, notices, governing law and jurisdiction are governed by the Agreement (§§13, 16 and 19). Any decision may be challenged through the Complaints Procedure.

15.2 Language

The governing language of these Terms is English. Translations are provided for convenience; the English version prevails to the extent permitted by applicable law (Agreement §16.7).

15.3 Severability

If a provision of these Terms is invalid, unlawful or unenforceable, the Agreement §20.2 applies.

Annex 1 — Account Configuration Offered

The Account Configuration binding on an Account is the one stated in its Account Summary. At the date of these Terms, ZoneX offers the following. The daily loss percentage refers to the Daily Reference Balance; every other percentage refers to the Starting Reference Level.

Annex 2 — Illustrations

Illustration only: every example below assumes a Starting Reference Level of USD 10,000, a daily loss percentage of 3%, a maximum drawdown percentage of 5% (a Maximum Drawdown Amount of USD 500), a Remuneration Percentage of 80% and the remuneration conditions in Annex 1.

Illustration 1 (Daily Loss Limit). The Daily Reference Balance is USD 10,000, so the Daily Loss Limit is USD 300. During the Trading Day the Trader realises a profit of USD 200 and then a loss of USD 350: the net loss realised is USD 150. Position A has an Open Risk of USD 100. Position B has its stop-loss in profit, so its Open Risk is nil and it offsets nothing. The total of USD 250 is below USD 300. Placing an order that would add an Open Risk of USD 60 brings the total to USD 310, which exceeds USD 300: the Daily Loss Limit is breached when the order is placed.

Illustration 2 (Maximum Drawdown). The Drawdown Floor is initially USD 9,500. With a High-Water Mark of USD 10,300 it is USD 9,800. With a Realised Balance of USD 10,000 and an Open Risk of USD 250, the Realised Balance less the Open Risk is USD 9,750, below USD 9,800: the Maximum Drawdown is breached. Once the High-Water Mark reaches USD 10,500 or more, the Drawdown Floor stays at USD 10,000, the Starting Reference Level.

Illustration 3 (Calculation and Reservation). After the waiting period, the Account is flat with a Realised Balance and Daily Reference Balance of USD 10,600. The Window Profit is USD 600 and the Best Day USD 150, a Consistency Ratio of 25%. The Buffer is USD 300 and the maximum Calculation Amount USD 500. The Calculation Amount is the lowest of USD 500, USD 300 and USD 300, so USD 300, and the Performance Remuneration is USD 240. On the request, the Realised Balance falls to USD 10,300. The High-Water Mark stays at USD 10,600 and the Drawdown Floor at USD 10,000.

Illustration 4 (Consistency Ratio). With a Window Profit of USD 600 and a Best Day of USD 250, the Consistency Ratio is 41.7% and the condition of Section 9.1(c) is not met. This is not a breach. With no larger Best Day, the condition is met once the Window Profit is at least USD 833.34.

Illustration 5 (Payout Window). The Window Profit over completed Trading Days is USD 600, the Best Day USD 150 and the Daily Reference Balance USD 10,600. By 15:00 the Trader has realised a further USD 200 on the current Trading Day and is flat, so the Realised Balance is USD 10,800. A request at 15:00 has a Calculation Amount of USD 300 (the lowest of USD 500, USD 300 and USD 500) and a Performance Remuneration of USD 240. After the reservation the Realised Balance is USD 10,500 and the Daily Reference Balance USD 10,300, which sets the Daily Loss Limit for the rest of that Trading Day at USD 309. The new Payout Window begins at 15:00 and its waiting period runs from then. The USD 200 realised before 15:00 does not count towards it. If the Trader realises a further USD 120 after 15:00, that Trading Day counts towards the new Payout Window with USD 120. If ZoneX later rejects the request under Section 12.4, the USD 300 is restored and the previous Payout Window continues: that Trading Day counts towards it in full, with USD 320.

REVISION HISTORY

  • Version 1.0 — Initial version.
